The Hokie Way 50/50 - Rules of Play

Please read these Official Rules before entering the The Hokie Way 50/50 Raffle (the “Raffle”).  By purchasing a ticket, you represent that you meet all of the below-stated requirement and agree to be bound by these Official Rules, and by the decisions of The Hokie Way (“THW”), (the “Sponsor”), a 501(c)(3) charitable organization, or its representative.

1.      THE RAFFLE:  The Hokie Way (“THW”) 50/50, (“Sponsor”) is a raffle whereby tickets are sold before and during football games in Lane Stadium and surrounding areas, and during Men’s and Women’s basketball games in Cassell Coliseum and surrounding areas. In both football and basketball, the winning number will be posted to THW website (www.thehokieway.org) after each game. One fan that has purchased a raffle ticket will for that particular game/raffle win fifty percent (50%) of the net proceeds (also known as “Pot”, or “Pool”).  All remaining proceeds from the Raffle shall be retained by The Hokie Way. A portion of The Hokie Way’s proceeds will be donated directly to a select charitable partner.  Unless otherwise promoted, each raffle begins approximately two hours prior to game time and ends at the beginning of the 4th quarter in football and the beginning of the 2nd half in basketball (each a “Raffle Period”). THW may also sponsor raffles on days and times not associated with football or basketball games.

2.      ELIGIBILITY:  The Raffle is only open to anyone eighteen (18) years of age and older as of the date of purchase.  Only one winner per ticket is allowed.

3.      ENTRY:  You may enter the Raffle, if you meet the eligibility requirements, by agreeing to follow these Official Rules and purchasing Raffle tickets at various price points from our stationary selling locations, and from Raffle sales representatives roaming in or around stadium or arena locations. All Raffle ticket purchases must be completed by the end of the applicable Raffle Period.  The Sponsor is not liable for any lost, later, misdirected, incomplete, illegible, undelivered, or destroyed tickets regardless of cause or person responsible including, but not limited to, any problem or technical malfunction of any computer, online system or server or technical problem.

4.      DRAWING:  The prize winner will be selected in a random drawing from among all eligible Raffle tickets purchased during each Raffle Period.  The drawing will be held on or about the middle of the 4th period in football, and on or about the middle of the 2nd half in men’s basketball, and after the 3rd quarter in women’s basketball of the applicable game. The drawing will be conducted by the Sponsor whose decision will be final.  The selected Raffle number will be announced by the PA Announcer and on the video scoreboard during games.  It will also be posted on www.thehokieway.org. In the event the scoreboard or microsite is inoperable, the selected raffle ticket/number can be found at www.thehokieway.org.

5.      HOW TO CLAIM A PRIZE:  To claim a prize, the holder of the selected Raffle ticket (a “Prize Claimant”) must contact Sponsor and present the winning Raffle ticket. The 50/50 Raffle ticket is the only valid receipt for claiming a prize and must be redeemed either in person or via mail.  Each Prize Claimant must provide Sponsor with all information required to claim a prize (including tax identification information).  The Prize Claimant will receive a Drawing Award Receipt (“Affidavit”) in the form approved by Sponsor which must be executed and returned to Sponsor prior to receipt of the Prize.  In the event a Prize Claimant:  (a) does not notify Sponsor within thirty (30) days of drawing; (b) is ruled ineligible for any reason; (c) refuses the prize: or (d) does not return an executed Affidavit within thirty (30) days, the Prize will be forfeited and will be retained by Sponsor.  Sponsor has no obligation to contact potential winners.  All prizes will be delivered via check within thirty (30) days of the winner delivering the winning Raffle ticket, executed Affidavit, and all other required documents to Sponsor.  For security and safety reasons, no cash payments will be made to Raffle winners.  Unclaimed winnings will be retained by the Sponsor.

6.      TAXES:  Each participant acknowledges that they have been informed that the IRS has taken the position that amounts paid for chances to participate in raffles, lotteries, or similar programs are not gifts and, therefore, the price of a Raffle ticket does not qualify as a deductible charitable contribution.  The Prize Claimant is solely responsible for any and all federal, state and local taxes, fees and other government assessments on the awarded prize.  Furthermore, each Prize Claimant acknowledges that federal law may require a tax withholding on certain prize values that must be collected from winners’ award or distribution.  Federal, state withholding laws are subject to change without notice.  The withholding laws in effect at the time each prize is claimed will be followed.

7.       ODDS: The odds of winning the raffle are based on the total number of raffle tickets purchased during the raffle period.

8.      DISPUTES AND GOVERNING LAW: The Raffle shall be governed by the laws of the Commonwealth of Virginia without giving effect to any choice of law or conflict of law rule of any jurisdiction. Any claims regarding the Raffle that are not released, must be brought in the Circuit Court for Montgomery County or the United States Court for the Western District of Virginia, Roanoke Division, and Participant hereby consents to the personal jurisdiction of such courts for purposes of any such action. The Raffle is void where prohibited by law. Each Participant agrees that (1) any and all disputes, claims, and causes of action not waived arising out of or in connection with the Raffle, or any prizes awarded, shall be resolved individually, without resorting to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffle, but in no event attorneys' fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN NO EVENT SHALL THW OR ANY OF THE OTHER RELEASED PARTIES BE LIABLE TO FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE AWARDED TO ANY INDIVIDUAL PARTICIPANT IN THE RAFFLE.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE RAFFLE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF THESE OFFICIAL RULES AND OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THW MAY DISQUALIFY, AND THW RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW FROM, ANY INDIVIDUAL RESPONSIBLE FOR THE ATTEMPT.

How to Claim a Prize
